Applicable to all users of the Platform.
APPLICABILITY AND ACCEPTANCE
These general terms and conditions apply to any use of the Platform, including registration, onboarding, trial use, account activation, ride processing, community use, payment processing, Wallet functionalities, Stripe Connect, Stripe Treasury, Stripe Financial Accounts, subscriptions, network fees and other services of Driv3.
By registering, digitally accepting, ticking an acceptance box, starting onboarding, using the Platform, activating an account, using financial functionalities or continuing to use the Platform after changes to these terms, the user accepts these general terms and conditions.
Driv3 may record proof of acceptance, including the date, time, account ID, user ID, IP address, email address, device data, version of the terms and method of acceptance.
If a user acts on behalf of a company, carrier, community, client or other legal entity, that user declares that they are authorised to bind that party to these terms.
If a user does not agree to these terms, the user may not use the Platform.

1. DEFINITIONS
Platform
The digital infrastructure operated by 020 Service Beheer B.V., trading under the name Driv3, for the distribution, administration and processing of rides within the transport industry.
Driv3
020 Service Beheer B.V., trading under the name Driv3, being the operator of the Platform.
Carrier
Any natural person or legal entity that offers, performs, receives, forwards or administratively processes transport services through the Platform.
Driver
A natural person who performs a ride, either independently or under the responsibility of a carrier.
User
Any carrier, driver, company, contractor, dispatcher, admin, employee, community holder or other natural person or legal entity that uses the Platform.
Passenger
The end customer for whom a ride is performed.
Corporate Customer
A business customer of a carrier.
Ride Order
A transport request registered, received, planned, forwarded, accepted or performed through the Platform.
Direct Ride
A ride where the performing carrier directly contracts with the passenger.
Regular Customer / Subcontracting Ride
A ride performed for another carrier’s client.
Account Ride
A ride performed on invoice or deferred payment.
Stripe
Stripe entities and partners involved in financial processing.
Wallet
The interface showing balances and financial activity. Not a bank account.
Balance
Amount displayed as available, reserved or pending.
Available Balance
Funds available for use.
Reserved Balance
Funds blocked or reserved.
Top-up
Adding funds via supported payment methods.
Refund / Payout
Transfer of funds to external account.
Subscription
Paid access to platform features.
Network Fee
Fee charged by Driv3 on forwarding fees.
Stripe Costs
All costs charged by Stripe or partners.
2. PLATFORM ROLE AND AUTONOMY
2.1 Infrastructure function
- Does not perform transport
- Not a party to transport agreements
- Not employer of drivers
- No income guarantee
2.2 Independence
Users operate independently and define their own operations.
2.3 No guarantee
No guarantee of rides or revenue.
2.4 No exclusivity
Users can operate outside the platform.
2.5 Business use
Platform is for professional use only.
3. STRIPE & PAYMENT PROCESSING
3.1 Infrastructure
Stripe powers payments, wallets, and financial tools.
3.2 Connected Account
Required for onboarding, payments, and compliance.
3.3 Financial Account
Optional layer for holding and managing funds.
3.4 Balance ownership
Funds are held via Stripe, not Driv3.
3.5 Not a bank
- Not a financial institution
- No deposits or credit issued
3.6 Approval
Stripe approval required for all financial features.
3.7 KYC/KYB
Mandatory identity and business verification.
3.8 Availability
Features depend on country and approval.
3.9 Wallet
Displays financial data only.
3.10 Balance types
Available, reserved, pending, blocked.
3.11 Corrections
Adjustments may be applied for errors or disputes.
3.12 Top-ups
Subject to delays, checks, and limits.
3.13 Provisional balance
Temporary credit may be reversed.
3.14 Payouts
Dependent on Stripe and banks.
3.15 IBAN
Provided by Stripe, not Driv3.
3.16 Mutual payments
Users responsible for legality.
3.17 Passenger payments
Via card, QR, Tap to Pay, etc.
3.18 Cards
Debit cards may be issued if approved.
3.19 Limits
Limits may apply based on risk and account status.
4. RIDE STRUCTURE
4.1 Direct rides
Contract between passenger and carrier.
4.2 Subcontracting
Original carrier remains responsible to client.
4.3 Selection
Carriers choose partners freely.
4.4 Tariffs
Set independently by carriers.
4.5 Responsibility
Users must ensure accurate ride data.
4.6 Acceptance
No obligation to accept rides.
5–17 OTHER PROVISIONS
Sections 5 through 17 include detailed rules on subscriptions, fees, liability, suspension, compliance, data protection, invoicing, intellectual property, anti-circumvention, tax reporting (DAC7), CDT compliance, force majeure, and final legal provisions.
All provisions follow the same principles: user responsibility, Stripe dependency, platform neutrality, compliance requirements, and operational independence.
